Terms of Service (SmartNFlex App)

These Terms and Conditions ("Terms") govern your use of the SmartNFlex Ltd website, app, NFC-enabled products, and related services. By creating an account, registering a product, or accessing any part of our platform through a web browser or NFC-enabled device, you agree to be bound by these Terms. Please read them carefully before using our services.

1. Product Description

SmartNFlex Ltd provides NFC-enabled tags and digital services that allow users to store and share information, such as pet details or business profiles. When someone scans a SmartNFlex tag with an NFC-enabled device, they can access the linked profile and optionally share their current location with the registered owner.

2. Account Creation and Product Registration

Users must create an account on our website or app and agree to these Terms before registering a SmartNFlex product. Each product comes with a unique activation code that must be entered to link it to your account.

3. Information Provided

After activation, users can enter and update profile information, such as pet details, contact details, or business information. You are responsible for keeping this information accurate and up to date at all times.

4. NFC, Location & Photo Sharing

When someone scans a SmartNFlex product, they may access your profile and submit their current location or a photo. This information is securely transmitted and viewable only by the registered product owner.

We do not guarantee the accuracy of location data or the authenticity of photos submitted by third parties. The finder is solely responsible for any photo or information they upload.

5. Data Privacy

SmartNFlex Ltd values your privacy and complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We collect and process personal data such as account details, profile information, location submissions, and photos only for the purpose of delivering our services.

Personal data is securely stored and never sold or shared with third parties without your consent. Location data and photos submitted by finders are transmitted securely, stored temporarily, and shared only with the registered account holder.

In accordance with UK GDPR, you have the following rights:

  • To access the personal data we hold about you

  • To request correction of inaccurate information

  • To request deletion of your data (“right to be forgotten”)

  • To request a copy of your data in a portable format

  • To object to or restrict certain types of processing

6. Limitations and Warranty

SmartNFlex products include a limited 2-year warranty covering manufacturing defects under normal use. If your product stops functioning due to a material or workmanship issue within 24 months of purchase, we will replace it free of charge.

However, SmartNFlex Ltd does not guarantee the recovery of lost pets, successful networking outcomes, or NFC scans in all conditions. We are not liable for lost or damaged products due to misuse, chewing, extreme conditions, or accidents. The service is provided “as-is” and we make no guarantees about performance or compatibility on all devices.

7. Prohibited Use

You agree not to misuse our platform, tamper with products, harvest data, or impersonate others. We reserve the right to suspend or terminate accounts for violations of these terms.

8. Changes to Terms

We may update these Terms from time to time. Continued use of the app or products after changes are published indicates acceptance of the revised Terms.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
